Hong Kong Visa

While Mainland China always requires a visa for entry, Hong Kong is a separate travel area with business-friendly immigration policies.

Visitors from over 170 countries/territories enjoy visa-free entry into Hong Kong, with limits ranging between seven and 180 days.

Working visa requirements

Foreign nationals normally need a visa before living or working in Hong Kong. But Hong Kong’s light-touch visa policies mean that short-term visitors are permitted to conduct business negotiations and sign contracts while on a visitor’s visa or entry permit.

Hong Kong visa types

Investment visa

This requires you to be a shareholder of a Hong Kong registered company. You can do this by:

·         Registering and setting up a company in which you are the major investor, or

·         Investing in a Hong Kong-based company

You will also need to produce details of the viability of your proposed business – or your financial position if you are investing in an existing company.

Capital Investment Entrant Scheme (CIES)

Approved CIES applicants can seek employment or establish a business in Hong Kong. Requirements are:

·         A capital investment of HK$10 million into a legitimate asset class in Hong Kong

·         Evidence that you can support yourself

·         Evidence that you can support any dependents without public assistance

Dependent visa

People who successfully apply for a visa can bring their spouse and dependent children under the age of 18, provided they have sufficient funds and suitable accommodation. The limit on their stay is the same as the visa holder – who is officially the ‘sponsor’. A spouse holding a dependent visa can undertake any type of lawful employment in Hong Kong.

Application Procedure and Timeline

The completed application along with supporting documents must be submitted to Hong Kong Immigration Department by post. The application processing time is about 4-6 weeks.

If the application is successful, the Immigration Department will issue a Visa/Entry Permit label which must be collected from the immigration office in-person by the applicant or an authorized representative. The Visa/Entry Permit label must be affixed on a blank visa page of the applicant’s passport and presented to the Immigration Officer upon arrival in Hong Kong. In case the work permit application is rejected, an appeal can be filed with authorities.

If the authorities find that your commitment to your business and the economy of Hong Kong is genuine and strong, that you have the adequate capital to support your business plans and that you satisfy all the eligibility criteria, it is unlikely that your investment visa application will be rejected. However, in the event of your application getting rejected, you can approach the authorities for an appeal.
